MLProList Terms and Conditions  

TERMS AND CONDITIONS This is a legal agreement between you and MLProList domain for the use of FREE or PRO accounts (referred as the \' Promotion Service\'). Ordering the Promotion Service or signing up for a free account of the service constitutes your agreement with the terms and conditions of this Agreement. If you do not agree to all of the terms and conditions of this Agreement, please do not order the Promotion Service or sign up for a free account of the Promotion Service. THE PROMOTION SERVICE The Promotion Service consists of MLProList accounts assigned to an e-mail address of domain www.mlprolist.com. You will be assigned an Internet address (URL) that will allow you to modify your account’s settings via Your Member Area. Members agree to receive email messages from other list members. GENERAL MLProList exercises no control whatsoever over the information and data passing through its facilities. If you are dissatisfied with the Promotion Service or with any terms, conditions, rules, policies, guidelines, or practices in operating the Promotion Service, your sole and exclusive remedy is to discontinue using the Promotion Service. MEMBERS RESPONSIBILITIES FREE Members are entitled certain services free of charge. Free members are allowed to mail out to the MLProList database twice every day to the number of members upon the credits available in their account for free. PRO members are charged a monthly fee of $19.00 from their account balance and it’s their responsibilities to have the funds available in their accounts. When the paying member wishes to cancel his/her PRO membership, he/she must let MLProList know of this decision 2 business days before his / her billing date. NO REFUNDS ARE AVAILABLE if PRO members are already charged. Do not use misleading headlines while sending messages. Always use appropriate subject lines that relates to your message. These subjects are strictly prohibited * RE: or re: * Fwd: * PayPal (or any other payment processor) has cancelled your account * URGENT * Your account has been cancelled / deactivated / terminated * From admin / administration * Notification of payment received * I read your ad / I saw your ad You are solely responsible for all Service activities while using our Promotion Systems. Possession and usage of all information obtained from MLProList is at your own risk. You are not allowed to promote or email members with Adult oriented, Illegal, Warez Sites, Racial, Drug-Related or Other Illegal Content or other offensive websites. You are not allowed to counter offer to the member emails you receive, or the use of flaming or foul language to other members. You are not allowed to let others access and use the Promotion Service, nor make your password visible to others. You may not attempt to find out the password of another user of the Promotion Service. You are not allowed to use Auto responders. You are responsible of your own mailbox and need to assure that it will never be full to avoid bounce email. DISCLAIMER OF WARRANTIES, LIMITATION OF LIABILITIES, INDEMNIFICATION MLPROLIST DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR FREE OR UNINTERRUPTED. THE SERVICE IS DISTRIBUTED ON \\\\\\\\\\"AS IS\\\\\\\\\\" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. MLPROLIST WILL NOT BE RESPONSIBLE FOR ANY LOSSES, DAMAGES OR COSTS THAT YOU AND/OR YOUR BUSINESS MAY SUFFER WHEN USING THE SERVICE. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS ON MLPROLIST, FROM ANY CLAIMS RESULTING FROM YOUR USE OF THE SERVICE. YOU EXPRESSLY AGREE THAT THE USE OF THE SERVICE IS AT YOUR SOLE RISK. NEITHER MLPROLIST NOR ITS SERVICE PROVIDERS, AGENTS, LICENSORS,AND EMPLOYEES SHALL HAVE ANY LIABILITY FOR ANY DAMAGES SUFFERED BY YOU OR ANY OTHER PARTY AS A RESULT OF THE USE OR MISUSE OF THE SERVICE. USAGE OF THE PROMOTION SERVICE The Promotion Service may be used for lawful purposes only. Transmission or storage of pornography and sex-related content and merchandising and/or any material in violation of any international, federal or any state law or regulation is expressly prohibited. You agree not to send unsolicited bulk e-mail messages using the Promotion Service or the mentioning of e-mail address or URL(s) that is maintained on MLProList. Such action will result in immediate termination of your account without refund or compensation. You will also be in violation to this Service Agreement and subject to legal action and responsible for all legal fees incurred. You agree not to provide false or misleading information on the Promotion Service sign up form. This includes, but is not limited to, providing false name(s) or e-mail address(es). PRO members will use the list member\'s first and last name as a personalization feature. You agree not to provide false or misleading information on the Promotion Service Settings web page. This includes, but is not limited to, providing a false e-mail address in FROM: field. You agree to receive emails from other FREE/PRO MLProList Members. You agree to receive e-mail updates from MLProList. These include our newsletters, service updates, new product information and advertising messages from our sponsors. You may remove your account. Your privacy is protected and your e-mail will not be shared with any third party. Your membership type will be changed automatically to that of a FREE member if payment is not processed upon the funds in your account. MLProList have the right to suspend service to the subscriber at any time, and for any reason, without notice. If such a suspension is to last for more than 15 days, the subscriber will be notified as to the reason. Should you violate any of the terms of this Service Agreement, MLProList reserves the right to immediately terminate your access and use of the Promotion Service without prior notice, refund, or compensation. These terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with the terms and conditions of any order submitted. Pro Members must accept additional Pro Member Terms and Conditions. In the event that any of the terms, conditions, and notices contained herein conflict with the Pro Member Terms, the Pro Member Terms shall control. MLProList reserves the right to change the terms, conditions, and notices under which the MLProList Web Sites are offered, including but not limited to the charges associated with the use of the MLProList Web Sites. You should visit this page from time to time to review the then-current Terms because they are binding on you.
